Affiliate Terms and Conditions

Welcome to our affiliate program! Wer’e excited to have you as a promoter for our campaigns. Before you get started, please read and understand the following terms and conditions governing your participation in our affiliate program.

1. Eligibility and Enrollment:

1.1. To become an affiliate promoter, you must be at least 18 years old and agree to abide by these terms and conditions.

1.2. You can apply for enrollment by completing the affiliate application available on our website. We reserve the right to accept or reject any application at our sole discretion.

1.3. Declaration of Accuracy: By submitting your application, you declare that all information provided is true and correct. You understand that any willful dishonesty may result in the rejection of your application or immediate termination from the affiliate program.

2. Promotional Requirements:

2.1. To be eligible for payouts, you must achieve a minimum of $100 in earned commissions and bring in a minimum of three (3) unique and paying customers through your affiliate links or promotional efforts.

2.2. Commission earnings will be based on the actual paid transactions made by the referred customers.

3. Self-Referral Policy:

3.1. Prohibition of Self-Referral: You must not use your own affiliate links for personal purchases.

3.2. Investigation of Suspected Self-Referral: For any suspected self-referred transaction, we may request you to provide sufficient evidence to clarify your promotional methods. However, the outcome of such investigations will be fully at our discretion.

3.3. Consequences: Violations will result in termination from the program and forfeiture of all earned commissions.

4. Payout and Payment Schedule:

4.1. Payouts will be made on a net-45 basis, meaning you will receive your commissions 45 days after the payment is received from the referred customers.

4.2. Commissions will be paid via the payment method specified during your affiliate enrollment process. We are not responsible for any fees or charges incurred in the payment process.

5. Tracking and Assets:

5.1. To track your affiliate performance, you will receive a unique affiliate link or tracking code, which must be used for all promotional activities.

5.2. You can access promotional assets, creatives, and tracking tools at https://surgegraph.firstpromoter.com. You agree to use these materials only for the purpose of promoting our campaigns and services.

6. Compliance and Ethical Promotion:

6.1. As an affiliate promoter, you are responsible for ensuring that all promotional activities comply with applicable laws and regulations, including data protection and privacy.

6.2. You must refrain from engaging in any misleading, false, or deceptive advertising and avoid infringing on the intellectual property rights of others in your promotional materials.

7. Termination:

7.1. We reserve the right to terminate your participation in the affiliate program at any time and for any reason without prior notice.

7.2. If your account is terminated due to violations of these terms and conditions or any fraudulent activity, you will not be eligible for any outstanding commissions.

8. Modification of Terms:

8.1. We may update or modify these terms and conditions from time to time. Any changes will be effective upon posting on our website, and it is your responsibility to review them regularly.

9. Additional Provisions:

9.1. Intellectual Property: You may use our logos and trademarks only as provided in our promotional materials. All intellectual property rights are reserved.

9.2. Relationship of Parties: You are an independent contractor. This agreement does not create an employment relationship.

9.3. Confidentiality: You must maintain the confidentiality of any proprietary information received during your participation in the program.

9.4. Indemnification: You agree to indemnify SurgeGraph against any claims or damages arising from your promotional activities.

9.5. Limitation of Liability: SurgeGraph will not be liable for indirect, special, or consequential damages arising out of this agreement.

9.6. Marketing and Communication Guidelines: Follow our guidelines and include necessary disclaimers as per FTC guidelines when promoting our products.

9.7. Inactive Account Policy: Accounts inactive for over 12 months may be closed.

9.8. Data Protection: Comply with GDPR and other relevant data protection regulations in handling customer data.
